Please read these Terms and Conditions carefully before using the SoundScape application.

Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of these Terms and Conditions:

  • Application means the software program provided by the Company downloaded by You on any electronic device, named SoundScape.

  • Application Store means the digital distribution service operated and developed by Apple Inc. (Apple App Store) in which the Application has been downloaded.

  • Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Studio Next Ltd., 68B Gascony Avenue Street, United Kingdom.

  • Country refers to: United Kingdom

  • Device means any device that can access the Application such as a computer, a cellphone or a digital tablet.

  • Service refers to the Application.

  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Acknowledgment

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service.

By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.

You represent that you are over the age of 13. The Company does not permit those under 13 to use the Service.

Description of Service

SoundScape is a wellness audio application that helps users create personalized ambient soundscapes for sleep, relaxation, focus, and meditation. The app allows users to mix multiple sounds together, adjust individual volumes, save favorite combinations, set sleep timers, and explore binaural beats for brainwave entrainment.

Audio Content

The Service provides various audio content including ambient sounds, nature sounds, white noise, music, and binaural beats. You acknowledge that:

  • Audio content is provided for personal, non-commercial use only
  • You may not redistribute, sell, or share the audio content outside the Application
  • Binaural beats are provided for relaxation purposes and are not medical treatments
  • The effectiveness of audio content for sleep or relaxation may vary between individuals

User Content

You retain ownership of all custom mixes and configurations you create within the Application. Your content is stored locally on your device and is your responsibility to back up.

Subscriptions

Premium Subscription

SoundScape offers a Premium subscription that unlocks additional features including unlimited access to all sounds, custom sound mixing, binaural beats, sleep insights, and an ad-free experience.

Subscription Terms

  • Free Trial: New subscribers may be eligible for a 7-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.
  • Pricing: Premium subscription is available at $4.99 USD per month (or equivalent in your local currency). Prices may vary by region and are subject to change.
  • Billing: Payment will be charged to your Apple ID account at confirmation of purchase, or at the end of the free trial period if applicable.
  • Auto-Renewal: Your subscription will automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Managing and Cancelling Your Subscription

You can manage or cancel your subscription at any time through your Apple ID account settings:

  1. Open the Settings app on your iPhone or iPad
  2. Tap your name at the top
  3. Tap "Subscriptions"
  4. Select "SoundScape" from your list of subscriptions
  5. Tap "Cancel Subscription" to turn off auto-renewal

Cancellation will take effect at the end of your current billing period. You will continue to have access to Premium features until your subscription expires. No refunds will be provided for any unused portion of a subscription period.

Free vs Premium Features

SoundScape offers both free and premium content. Free users have access to a selection of sounds with limited mixing capabilities. Premium subscribers unlock the full library and all features.

Health Disclaimer

SoundScape is designed to promote relaxation and better sleep. However:

  • The app is not a medical device and should not be used as a substitute for professional medical advice
  • If you have a sleep disorder or other health condition, please consult a healthcare professional
  • Binaural beats should not be used while driving or operating machinery
  • If you experience any discomfort while using the app, discontinue use immediately

Intellectual Property

The Service and its original content (excluding User Content), features and functionality are and will remain the exclusive property of the Company and its licensors. The Service is protected by copyright, trademark, and other laws of both the Country and foreign countries.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of these Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Disclaimer

The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. The Company makes no warranty that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free.

Governing Law

The laws of the United Kingdom, excluding its conflicts of law rules, shall govern these Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

Changes to These Terms

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.

By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the Application.
